Here, the special owner is only a co-owner to the extent of his share.

Essentially, residential property law differs from general or simple property law in that the former combines ownership of a specific property (house, flat, business premises, parking space, etc.) with a share in common property, whereas the latter does not involve this duality.Special ownership is a right that is largely identical to general full ownership, as it enables the owner to use the property to the exclusion of third parties and grants them sole power of disposal. In contrast, the special owner only has a share in the common property in proportion to their quota. Joint ownership generally serves all elements of special ownership equally.

The origin of the legal distinction between special and common property, and thus the creation of what is understood as residential property, dates back to the 17th century in Spain. However, a more comprehensive regulation of this special form of ownership was not introduced until the amendment to Article 396 of the Civil Code by the Act of 26 October 1939.

The different apartments or business premises of a building or parts thereof which are accessible for independent use because they have their own exit to a common element of the building or to a public road may be subject to separate ownership which is inseparably linked to a co-ownership right to the common elements of the building which are necessary for their use and enjoyment, such as the land, the buildable airspace above the property, foundations and roofing;
